Terms & Conditions of Sale – Vivienne Littley Art

These Terms & Conditions of Sale (“Sale Terms”) apply to all purchases of artwork and products made through https://viviennelittley.com/ (the “Website”). By placing an order, you agree to these Sale Terms.

Products
We sell original artworks and related items through the Website. Product descriptions, prices and availability are shown on the relevant product pages.
We aim to describe and photograph items accurately. However, colours may vary depending on your screen/device settings. As artworks are created by hand, small variations in texture and appearance are normal and part of the work’s character.
Prices
- All prices are shown in [GBP] unless stated otherwise.
- Prices may change at any time, but changes will not affect orders already placed and accepted.
- Delivery charges are shown at checkout or confirmed by email where applicable.
Placing an order
When you place an order, you are making an offer to purchase the item(s). Orders are subject to acceptance and availability.
You will receive an order confirmation email. A contract between you and us is formed when we accept your order and confirm payment.
We reserve the right to refuse or cancel an order if:
- the item is no longer available
- there is an error in pricing or description
- we suspect fraudulent or unauthorised activity
If we cancel your order, we will refund any payment received.
Payment
Payments are processed securely through Stripe. We do not store your card details.
Your payment must be authorised before the order is processed. In some cases Stripe may request additional verification.
Delivery
Delivery options, timescales and costs are shown at checkout or confirmed by email.
We take care to package artwork securely and appropriately.
Delivery times are estimates and may vary depending on location, courier services, and circumstances outside our control.
Risk and responsibility
Responsibility for the item passes to you when it is delivered to the address provided. Please ensure delivery details are correct.
International orders
If you are ordering from outside the UK, you may be responsible for import duties, local taxes, and customs fees. These charges are not included in our prices and are outside our control.
Damaged items
If your order arrives damaged, please contact us as soon as possible (ideally within 48 hours of delivery) and include photographs of:
- the outer packaging
- any internal packaging
- the damaged item
We will advise next steps, which may include replacement (where possible), repair, or refund.
Returns and refunds (UK customers)
If you are a consumer in the UK, you have rights under the Consumer Contracts Regulations and Consumer Rights Act 2015.
Change of mind (online orders)
You may have the right to cancel your order within 14 days of receiving your item, without giving a reason.

If you cancel:
- you must return the item within 14 days of notifying us
- the item must be returned in its original condition and packaging
- you are responsible for return shipping costs unless the item is faulty or damaged
Once we receive the return and confirm its condition, we will process your refund within 14 days. Refunds are made to the original payment method.
Faulty items
If an item is faulty or not as described, you have legal rights. Please contact us and we will work with you to resolve the issue promptly.
Original artwork and authenticity
Original artworks sold through the Website are created by Vivienne Littley unless otherwise stated. Ownership of the physical artwork transfers to you once payment has been received in full and the artwork has been delivered.
Copyright remains with the artist.
Purchasing an artwork does not transfer copyright or reproduction rights. You may not reproduce, copy, scan, or use the artwork for commercial purposes without written permission.
Commissions
Commissioned artwork is subject to separate written agreement, including price, size, timescales, and payment schedule.
Important: Because commissioned artworks are made to order, the 14-day cancellation right does not usually apply once work has begun, unless the artwork is faulty or not as agreed.
If a deposit is required, it will be confirmed in writing and may be non-refundable once work has started.
Gift purchases
If you are purchasing artwork as a gift, please ensure the delivery address is correct. We cannot be responsible for delays or non-delivery caused by incorrect address details.
Discounts and promotions
Any discount codes or promotions:
- must be used as stated and within the given time period
- may not be exchanged for cash
- may be withdrawn or amended at any time
Limitation of liability
Nothing in these Sale Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under law.
To the fullest extent permitted by law, we are not liable for indirect or consequential losses arising from the sale or use of any product purchased through the Website.
Governing law
These Sale Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to these Sale Terms
We may update these Sale Terms from time to time. The version published on the Website at the time you place your order will apply to that order.
